Turkish law doesn’t require foreign real estate investors or property owners to be physically present in Turkey to buy, sell, or rent out properties. They can do this from their hometown. However, they need to appoint someone to carry out the legal tasks on their behalf by granting them with the power of attorney.
What is a power of attorney?
Power of attorney is simply a legal document issued by a person to authorize someone else to carry out certain tasks on their behalf. This includes singing documents, making certain decisions, and overlooking your legal or financial affairs.
A power of attorney can be either general or specific. A general power of attorney grants the solicitor the right to represent the issuer in all matters. A specific power of attorney, on the other hand, specifies the task(s) the appointed person is authorized to perform.
Foreign real estate investors, buyers, and property owners can hire real estate agents and lawyers in Turkey for the following purposes:
- To buy, sell, and rent our properties
- To complete all the paperwork and sign the documents
- Make financial transactions
- Property management and maintenance
- To take care of tax
- Make property investments
- Make legal claims and conduct litigations
How to Grant the Power of Attorney to HomegaTurkey to Buy a Property On Your Behalf?
For property related measures in Turkey, we recommend our clients to issue a specific attorney to us. Here’s how to go about it:
Granting the Power of Attorney from Your Home Country
If you live in any of the 118 countries that are signatories to the Hague Convention 1961, you can easily issue a power of attorney from your hometown.
For those who do not know, the Hague Convention 1961 abolished the requirement of legislation for foreign public documents. This means that a legal document issued in any of the countries that signed the convention will be considered legal in all 118 countries.
Let us know if you are unable to travel to Turkey and we will send you the draft for the power of attorney, prepared as per your requirements and guidelines. Once you receive the draft, you will need to contact a local notary and get a legal power of attorney document prepared, according to the laws of your country. When the document is ready, you will need to sign it, in front of the notary.
The notary will then send the attorney document for verification tothe concerned legal body in your country. When you have the verified power of attorney, mail the original document to us.
Granting the Power of Attorney in Turkey
If you are present in Turkey, but cannot stay here until the whole property buying process is complete (which can take a while), then you only have to choose your property, and we will take care of the remaining steps.
To help you acquire the power of attorney, one of our lawyers will prepare the document for you. We then will also make an appointment with a Notary for you to sign the document. Our agent will accompany you to the Notary’s office to make sure you don’t face any problem.
